Dock Lease Rules

ESTERO HEIGHTS IMPROVEMENT ASSOCIATION
POLICY AND REGULATIONS GOVERNING USE OF TRACTS A & B AND THEIR RESPECTIVE BOAT BASINS
ISSUED MARCH 1979

This statement of policy and regulations is set forth to implement that portion of Article XI of the By-Laws which requires approval of the Board of Directors for the erections of boat docks in either Track A or Track B.

1. Use of the launching ramp on Track B shall be available to all lot owners within the subdivision who have paid their yearly maintenance assessment and the $200 special assessment for the ramp renovation.

2. Property Owners , who have paid their yearly maintenance assessment and whose property is bordered either by the Estero River or by any of the canals in the subdivision, shall not be eligible to rent docking space in Tracks A & B or to moor their boats in either basin.

3. Only property owners who have paid their yearly assessment and who have established their permanent residence in the subdivision shall be eligible to lease a dock in either boat basin. Assignment of spaces is handled by the Associations treasurer. Request for dock rental spaces must be made in writing to the Associations treasurer. Assignment of spaces will be made based on first come first serve basis. Date of written request will determine priority of assignment. Current Property Owners leasing dock space will have first option of changing docks prior to assignment of dock space from the waiting list.

4. Property owners currently leasing docks will have 30 days after March 1st each year to pay their yearly dock rental or relinquish said dockage to the Association . Property owners are encouraged to share their docking space with other residents who have paid their yearly maintenance assessment since dock space is limited. Leased dock spaces that are not being used for a period of 6 months shall be notified by written letter to relinquish their dock space to the Association.

5. Charges for rental of dock space shall be determined by the Board of Directors. Currently annual fee is $120.00 per dock. The Association will be responsible for the maintenance of the docks rented by the property owners.

6. Property Owners leasing docks from the Association do so on their own responsibility. Boat insurance is the sole responsibility of individual owners.

7. Property owners leasing docks from the Association are required to inform the Board of Directors should maintenance be required on their dock. Docks will be inspected on a regular basis by the Board of Directors or their designated representative.

8. Property owners leasing docks are responsible for keeping the area clean . The Association is not responsible for any personal items including the vessel parked at the leased dock.

9. The Public dock at Basin B is for residents use for loading and unloading their boat. Parking is limited to 15 min. to insure all residents have usage of the dock. UNDER NO CIRCUMSTANCES MAY A PROPERY OWNER USE THE PUBLIC DOCK FOR TEMPORARY MOORING FOR AN EXTENDED PERIOD OF TIME.

10. Docks constructed on Association property shall meet the following requirements.
1. Width between docks shall be 12 feet. The measurement does not include the width of the dock
Itself.
2. The maximum width of the dock shall be 30 inches. Pilings to be a minimum of 4 inches if square
and 4 inches diameter if round.
3. All planking and other lumber used in the construction shall be a minimum of two inches by 4
inches in size, with 2 inches by 6 inches recommended.
4. Treated lumber is recommended. The distance between pilings along the sides of the dock shall
be no greater than 7 feet.
11. Docks leased by a property owner are for their usage only. Property Owners leasing docks must complete a rental agreement prior to receiving their dock assignment. Dock assignments are to the owner of a property in the subdivision. They are not transferable to a new owner.

12. All docks must be kept in safe condition and in a state of good repair.
